At times, our customers using certain devices, including LTE and HSPA+ devices, may be connecting to T-Mobile’s network. When you are connected to T-Mobile’s network, T-Mobile’s policies apply.
MetroPCS Open Internet Transparency Disclosures
This MetroPCS Open Internet Transparency Disclosure is intended to inform consumers and content, application, service, and device providers regarding MetroPCS Communications, Inc. and its affiliates (hereinafter “MetroPCS”, “we”, or “our”) services and network management practices, and to allow such providers to develop, market, and maintain Internet offerings and devices for MetroPCS’ mobile broadband network.
Persons relying upon these disclosures should note that MetroPCS’ services and network management practices are dynamic and have and will change over time to reflect the need of MetroPCS to manage its mobile broadband networks in response to changed circumstances. As such, these disclosures are expected to be modified over time and subscribers and providers are encouraged to check these disclosures periodically to ascertain MetroPCS’ most current practices and policies.
Any questions, comments, complaints or concerns regarding these disclosures or MetroPCS network management practices, as well as any complaints or questions by end-users or edge providers regarding the approval of devices, should be directed to MetroPCS at email@example.com.
MetroPCS Wireless Networks and Performance Characteristics
MetroPCS operates wireless networks utilizing a variety of network technologies in different major metropolitan areas: 1xRTT Code Division Multiple Access (“CDMA”) networks, Evolution Data Only (“EVDO”) networks, and Long-Term Evolution (“LTE”) (which are often branded as “4G LTE”) networks (collectively, “mobile broadband Internet access networks” and the services provided thereon “mobile broadband wireless services”). MetroPCS-operated mobile broadband Internet access networks are referred to as “Home” areas; while coverage areas where MetroPCS customers receive service on other carriers’ networks are referred to as “Extended Home areas. MetroPCS and its dealers and agents also provide Internet access in selected locations to the Internet via WiFi hotspots. Additionally, MetroPCS makes available to its subscribers certain applications and services which may allow subscribers to access the Internet via WiFi hotspots and networks operated by third parties. Several handsets offered by MetroPCS have WiFi capabilities and MetroPCS subscribers may use WiFi hotspots of third parties with whom MetroPCS has no relationship and MetroPCS has no control over such Internet access. Unless otherwise specified, the network management practices and device certification policies described in this disclosure apply to the MetroPCS’ broadband mobile wireless services networks only in Home areas, but do not necessarily include MetroPCS’ WiFi hotspot services or mobile broadband Internet access services provided by third parties outside the Home areas in Extended Home Roaming areas or other WiFi hotspots, which may operate using broadband Internet services offered by other providers and would be subject to the network management practices of such other providers. MetroPCS does not operate any wired networks or provide wireline Internet access to subscribers.
The services provided, the speeds, latency, and other characteristics of the user experience, and the network management practices and device certification policies of MetroPCS, vary by wireless Internet access network. For example, 1xRTT CDMA technology, as defined by standards bodies, generally is designed to handle voice services, whereas EVDO and LTE technologies generally are designed by industry standards to handle data services. Further, the amount of spectrum available to each network, the spectrum band used to provide mobile broadband Internet access services, and the resulting capacity varies by geographic location. As a result, the network management practices and services provided by MetroPCS may vary by network and geographic location.
The 1xRTT CDMA, EVDO, and LTE networks operate on spectrum exclusively licensed or leased to MetroPCS in its geographic service areas in the personal communication services (“PCS”) and advanced wireless services (“AWS”) bands. Similar network management techniques will be utilized if and when MetroPCS implements service in other spectrum bands (e.g. 700 MHz). MetroPCS’ WiFi hotspots operate on unlicensed spectrum which MetroPCS must share with other users over broadband Internet networks that are not controlled by MetroPCS and the Internet access is provided by third parties. MetroPCS provides its mobile broadband Internet access services using finite amounts of spectrum, and MetroPCS’ services and network management practices are designed to allow MetroPCS to provide mobile broadband Internet access services profitably given its finite capacity constraints. For example, MetroPCS’ mobile broadband Internet access networks and services are designed and optimized to provide Internet access to mobile subscribers using featurephones and smartphones (including smartphones utilizing the Android operating system) but are not designed (and MetroPCS does not sell or support) other connected devices, such as laptop cards, dongles, pucks, or tablets.
Based on technology capabilities and mean non-busy hour field observations, the theoretical and typically experienced speeds of MetroPCS’ mobile broadband wireless networks are as follows:
· The 1xRTT CDMA network has theoretical peak data rates on the forward link in the range from 9.6 to 153.6 kbps, based on information from standards bodies, with typically experienced mean data throughput speed across all geographic areas on the forward link of 70 kbps based on total kilobytes of traffic as measured at the gateway for the period from 6:00 a.m. to 5:00 p.m.
· The EVDO network has theoretical peak data rates on the forward link of up to 3.1 Mbps, based on information from standards bodies, with typically experienced mean data throughput speed across all geographic areas on the forward link of 70-100 kbps based on total kilobytes of traffic as measured at the gateway for the period from 6:00 a.m. to 5:00 p.m. MetroPCS has implemented EVDO technology to allow increased data capacity for more users to provide better experience to its users at data rates similar to its 1xRTT CDMA network.
· The LTE network has theoretical data throughput speeds on the forward link of up to 22.7Mbps for a 5 MHz paired channel, based on information from standards bodies, with a typically experienced mean data throughput speed across all geographic areas on the forward link of 1Mbps on a 5 MHz paired channel based on total kilobytes of traffic as measured at the gateway for the period from 6:00 a.m. to 5:00 p.m. The typically experienced mean data throughput speed across all geographic areas for a paired 1.4 MHz LTE carrier is similar to the theoretical peak data rate of our EVDO network based on total kilobytes of traffic as measured at the gateway for the period from 6:00 a.m. to 5:00 p.m.
The actual data speeds of services delivered on the MetroPCS networks will vary, depending on, among other things, the amount of spectrum available to MetroPCS in the major metropolitan area, the type of spectrum used, the configuration of the network, the type of wireless access device used, the usage of the network, the number of users using the network, the distance of the user to the serving cell site, interference, geographic and atmospheric conditions, the speed and capacity of backhaul, and the performance of third party networks and services, including the public Internet. In addition, the data speeds for LTE will vary depending on the bandwidth of the LTE carrier which is devoted to the service, which varies from a paired 1.4 MHz carrier to up to a paired 5 MHz carrier.
MetroPCS’ Services and Commercial Terms
MetroPCS provides mobile broadband Internet access services which allow its subscribers to access the Internet from feature phones and smartphones. MetroPCS’ mobile broadband Internet access services are not designed for (and MetroPCS does not sell or support) connected devices, such as laptop cards, dongles, pucks, or tablets. Services provided over the Internet and, by extension, Internet access services, are generally provided on a best efforts basis. MetroPCS’ mobile broadband Internet access services are no different. MetroPCS provides its broadband mobile wireless services and Internet access on a best efforts basis without any guarantees regarding availability, capability, specific network speeds, latency, quality of service, priority or otherwise. MetroPCS also provides certain Internet access, including mobile broadband Internet access in Extended Home Roaming areas and WiFi hotspots, through third parties who also generally provide such services on a best efforts basis. The suitability of MetroPCS’ wireless networks for real-time applications depends on a number of factors, including the wireless network and the specific functions required by such real-time applications. MetroPCS currently does not provide any specialized services.
MetroPCS offers a variety of pricing plans that include unlimited data usage, as well as pricing plans that include limits on certain data usage. Currently, MetroPCS does not meter data usage, except in connection with certain legacy and current 4G LTE service plans and as described below, for exemplary purposes, with respect to certain legacy plans, but reserves the right to do so in the future. For those 4G LTE service plans, MetroPCS currently meters only certain multimedia streaming, such as streaming audio and video and multimedia file downloads. Multimedia streaming is commonly audio (such as music) and video which is provided in real-time using a connection between the user and a multimedia server (“Multimedia Streaming”). Multimedia Streaming may also be embedded in web pages as multimedia windows. Multimedia Streaming may utilize protocols such as Real-Time Protocol (RTP), Real-Time Control Protocol (RTCP), Real-Time Streaming Protocol (RTSP), Session Description Protocol (SDP), as well as Hypertext Markup Language (“HTML”), Hypertext Transfer Protocol (“HTTP”), various peer-to-peer (“P2P”) protocols, certain proprietary over User Datagram Protocol (“UDP”)/Transmission Control Protocol (“TCP”) protocols, and may also include certain multimedia file download services which effectively appear to the subscriber as streaming, such as Pandora and Netflix. Multimedia Streaming does not include, and any limits on Multimedia Streaming do not apply to, voice over Internet protocol (“VoIP”) services.
Legacy Plans. Certain legacy MetroPCS service plans no longer offered to new subscribers include usage limits on the amount of data included in the monthly service plan. For example, MetroPCS’ $40 LTE plan includes 100 megabytes of Multimedia Streaming data, and MetroPCS’ $50 LTE plan includes 1 gigabyte of Multimedia Streaming data. When a subscriber exceeds the included monthly allotment, the subscriber can opt either to not receive additional Multimedia Streaming data until the next monthly period or the subscriber may upgrade his or her service plan to a service plan with more included Multimedia Streaming during the month and only have to pay a pro-rata portion of the difference between the service plan with the larger amount of included Multimedia Streaming over the current service plan. If the subscriber opts not to upgrade to a different service plan, there is no additional charge for an overage in a particular session that may have exceeded the included Multimedia Streaming limit. Even if Multimedia Streaming is not available because a subscriber has exceeded the included monthly limit for Multimedia Streaming, the web page on which Multimedia Streaming is offered will still be accessible to the subscriber as well as the non- Multimedia Streaming content available on such web page.MetroPCS provides a tool which allows subscribers to determine their amount of usage against service plan limits and this tool can be found at https://login.metropcs.com/sso/login.aspx. Customers need to have established an account with a password prior to using this data usage monitoring tool. The tool is also available as an application available on some mobile devices called the MyMetro application. The data usage monitoring tool provides users with, subject to reporting cycles, real-time data usage information. Additionally, MetroPCS sends data usage notifications to customers via SMS at 90% and 100% data usage thresholds, for certain applicable services on certain rate plans.
MetroPCS offers service on a month-to-month, no-long term contract basis, and there are no early termination fees associated with MetroPCS’ mobile broadband Internet access services. With the exception of certain MetroPCS 4G LTE service plans which provide limits on Multimedia Streaming, MetroPCS’ data plans currently do not include any usage-based fees. MetroPCS offers a variety of service plans, that include data services. MetroPCS’ rate plans, along with descriptions of the services provided under each rate plan, may be viewed at the following web address: http://www.metropcs.com/plans/.
MetroPCS’ Network Management Philosophy
MetroPCS has designed its network management practices to deliver a rich mobile broadband Internet access experience to subscribers’ featurephones and smartphones generally on an unlimited basis at a reasonable price. Because, MetroPCS does not have unlimited mobile broadband spectrum, managing our networks responsibly is important to promote the use and enjoyment of our mobile broadband Internet service by all of our customers. If MetroPCS fails to manage its networks in a reasonable fashion, customers would be more likely to experience incidents that would negatively affect their mobile broadband Internet access experience, such as spam, viruses, security attacks, network congestion, dropped calls, and other risks and degradations of the services provided by MetroPCS to its subscribers. MetroPCS also has designed its network management practices to be consistent with the policies expressed and incorporated into MetroPCS’ Terms and Conditions of Service.
MetroPCS’ network management practices may include, but are not limited to, service plan design, service rules, and network practices. For example, MetroPCS may design a service plan with a data limit to allow MetroPCS to serve customers over limited spectrum. MetroPCS also restricts the type of end user device to receive mobile broadband Internet access services as a form of network management, as certain devices exhibit disproportionate use of network resources. MetroPCS also may design service plans that provide lower rates to customers who use MetroPCS’ network less or who choose not to receive certain services. MetroPCS’ Terms and Conditions of Service, which are crafted as a form of network management, limit service to certain types and models of devices and prohibit certain kinds of services, such as tethering or maintaining open lines of communication. Finally, network practices may include such practices as traffic shaping and caching. MetroPCS’ specific network management practices are described in greater detail below in “Network Practices.”
While MetroPCS undertakes various network management practices in an effort to provide a richer experience for its subscribers, MetroPCS makes efforts to utilize network management technologies that are as minimally intrusive to its customers as is reasonable, and that will enhance the customers’ mobile broadband Internet experience. As the demand for mobile broadband Internet access services evolves and changes, our network management practices are evolving, and will continue to evolve, to address the rapidly changing demands, challenges and threats that have the potential to negatively impact our customers’ mobile broadband Internet access experience. MetroPCS seeks to regularly improve the broadband mobile wireless Internet access service experience for all of our subscribers.
MetroPCS strives to use network management practices that are consistent with industry standards and are generally accepted at the time they are utilized, but, because the wireless industry changes rapidly, MetroPCS, cannot assure that it always employs the least intrusive, best, or most consumer friendly network management practices. Our reasonable network management practices are dynamic and are expected to change over time as we learn and adapt to changing circumstances and the rapidly evolving challenges, increasing demands and new threats to our networks and customers and as the traffic and usage patterns of our subscribers change and evolve. There may be circumstances, however, in which we cannot immediately address a particular issue. Additionally, there are various techniques for network management that currently are available but, due to various constraints, have not been deployed by MetroPCS. There also may be certain techniques that will only be available to MetroPCS in the future. Some techniques and technologies may be used in one major metropolitan area market, or for one broadband mobile wireless network or service, but not another, depending upon local variations in the available spectrum, the number of users, the number of active transactions, the types of transactions, the time of day due to varying congestion conditions, and the performance of third party networks and services, including the public Internet.
MetroPCS employs several security practices designed to ensure end-user security and to protect our subscribers, our networks and our infrastructure. Our mobile broadband Internet access services allow our subscribers to reach all lawful websites on the Internet. MetroPCS uses information provided by the International Watch Foundation (“IWF”) to identify web sites which contain illegal content, such as child pornography. MetroPCS also may utilize stateful packet inspection to identify illegal content. MetroPCS does not permit access to any web site that appears on the IWF’s list of known illegal sites. In addition, to protect its network and its subscribers from malware, viruses, and the like, MetroPCS uses a platform provided by a third party to restrict subscriber access to Uniform Resource Listing (“URL”) or Internet Protocol (“IP”) addresses based upon a number of factors, including those which have a reputation, history, country origin for IP, Domain Name Sever (“DNS”) name or other attributes identified as being malicious or engaged in illegal conduct by, among others, our vendors, malware, email providers, web researchers, and the Open Source Community. Further, MetroPCS maintains its own customer database for web sites, URLs, and IP addresses which have been observed by MetroPCS or other carriers as attempting to perform “Spear Phishing” attacks against MetroPCS customers (e.g., Short Message Service (“SMS”) claiming to be from MetroPCS directing the customer to an exploit laden URL).
As discussed in further detail below in “Network Practices – Congestion Management”, certain types of packets that make our networks and our users less secure are dropped from data streams. For example, we drop packets that include the following IP options: route-record, router-alert, loose-source-route, strict-source-route, Bad IP Options, Unknown Protocols, Stream and Security. Likewise, based on generally accepted mobile broadband Internet access services practices, we also may in the future deny access to certain ports commonly employed in attacks on our networks and on the mobile devices of our users based on information we receive.
Our mobile broadband Internet access services allow our subscribers to reach all lawful websites on the Internet. In an effort to provide our customers with a suitable mobile broadband Internet access experience, MetroPCS has adopted, and may adopt in the future, network management practices designed to reduce congestion over its network and, as a result, improve the overall experience for all subscribers. Increased network congestion has the potential to slow down the speeds obtained over the MetroPCS network, limit the capacity of the network, and potentially provide a less than optimal mobile broadband Internet experience for all of our customers. These network management practices include activities directly affecting the network (such as caching, compression, and other similar technologies), many of which are widely deployed on the Internet, and indirect management practices, such as price and service plan design.
As part of our network management practices, MetroPCS utilizes mobile Internet access gateway platforms for Internet traffic originating from, or terminating to, our subscribers who have Internet access included in their service plan and who have not specifically blocked access to the Internet from their mobile device. The platforms (and the management practices undertaken by MetroPCS using the gateways) are generally similar to those MetroPCS understands are undertaken by other broadband mobile wireless carriers, and in many instances other Internet access providers. MetroPCS offers Internet access through two different services. Our platforms allow users to access the Internet from featurephones which generally do not use HTML. In many cases, the content and the formatting of the web pages are altered to be compatible with the capabilities and user interfaces of mobile devices, and services such as Multimedia Streaming may not be available on all mobile devices.
MetroPCS also operates a gateway for mobile broadband Internet access traffic (“mobile Internet gateway platform”), including HTML traffic. This mobile Internet gateway platform allows MetroPCS to directly manage its mobile broadband Internet access network and the traffic moving through it. This mobile Internet gateway platform reduces the use of our broadband mobile wireless network and reduces congestion by optimizing HTML web browsing through the use of a number of techniques including, but not limited to, removing whitespace from HTML code comprising the pages and removing and optimizing HTML code in order to render a web page on a small screen mobile device. In addition, in order to improve speed and the user experience and reduce congestion in the network, MetroPCS also utilizes its mobile Internet gateway platforms to compress images and other content in web pages. Further, MetroPCS also utilizes caching on our mobile Internet gateway platform to improve its customers’ experience by storing browsed content and web pages locally in MetroPCS’ network, which results in faster response times for subsequent browser requests for the same data. Freshness and validation mechanisms are employed to ensure the cached data remains current. We also may employ proxy server optimization and caching to manage congestion on our networks and improve the user experience. MetroPCS’ mobile Internet gateway platform also is designed to optimize certain Multimedia Streaming services.
Different Multimedia Streaming services require different network throughput speeds and the actual streaming which may be accessed will depend on the MetroPCS service provided. For example, audio streaming (and VoIP) is generally accessible on networks when the network speed is in excess of 50 kbps. However, certain video streaming will not operate smoothly and without jerkiness on networks with throughput of less than approximately 384kbps. Because observed data rates vary based on a number of factors, Multimedia Streaming which may work at certain times (e.g., non-busy hour) or at certain locations may not work when the network is more loaded (e.g., during the busy hour) or at a different location. Accordingly, absent network practices such as those undertaken by MetroPCS, good quality video streaming would not be available on MetroPCS’ 1xRTT CDMA network. To provide Multimedia Streaming services over MetroPCS’ networks, the mobile Internet gateway platform uses various techniques to reduce the effective bit-rate of the stream to a level which is supportable by then-current Radio Access Network (“RAN”) and other network conditions.
Certain MetroPCS service plans include usage limits on the amount of data included in the monthly service plan. For example, MetroPCS’ $40 LTE plan includes 100 megabytes of Multimedia Streaming data, and MetroPCS’ $50 LTE plan includes 1 gigabyte of Multimedia Streaming data. MetroPCS provides a tool which allows subscribers to determine their amount of usage against service plan limits and this tool can be found at https://login.metropcs.com/sso/login.aspx, and described more fully above.
Efficient radio resource management is critical for the optimization of any wireless data system. As part of our network management practices, we employ certain congestion management techniques to resolve conflicts in the allocation of resources during the busiest times of usage of our network. Several points within our networks resolve these conflicts in favor of voice traffic, namely our base stations and switches. On a 1xRTT CDMA system, voice and data traffic are served using the same system, and our 1xRTT CDMA networks are designed to prioritize voice traffic over data traffic. One reason for such prioritization is that real time, streaming voice traffic cannot overcome the delays that data traffic can experience and still provide an acceptable user experience. In addition, voice traffic is used for E911 services. We utilize various commonly used techniques to prevent data usage that would impose undue costs, be harmful, disruptive, or interfere with our systems or services to other customers by preventing use of voice services. As a result, as the 1xRTT CDMA systems experiences greater loading, the 1xRTT CDMA network will reduce the data traffic either by reducing the number of available sessions or reducing the speed (e.g., bit rate) of the data traffic. When the 1xRTT CDMA system reaches the full capacity threshold, the 1xRTT CDMA network will not permit any new data traffic until the traffic is reduced on the network. If the 1xRTT CDMA network did not manage the data traffic, the entire network might be compromised and the network could fail for both voice and data, including E911 traffic. MetroPCS’ EVDO and LTE networks do not currently service voice traffic and as a result there is no need to, and MetroPCS does not, prioritize voice traffic over data traffic on these networks.
MetroPCS’ networks distribute radio interface and base station resources between various users and control data flows requesting transmission in the cell site. The network determines which users need to be assigned which specific resources. The network allows users to be multiplexed and scheduled in time (for 1xRTT and EVDO) and in time and frequency (for LTE), in order to allow for the efficient use of spectral and hardware resources to optimize user throughput and cell capacity. Scheduling is done dynamically for every transmission time interval, and is intended to promote fair distribution of resources between users, as well as priority for robust system control signaling. Scheduling may impose delays in receipt of data.
As part of our network management practices, we also perform stateful packet inspection to monitor and sometimes control data uses that impose undue costs, cause harm, are disruptive, or interfere with our systems or services to other customers. We currently use different stateful packet inspection devices for our 1xRTT CDMA, EVDO, and LTE networks. Accordingly, the network management practices undertaken on each may vary based on the design and configuration of the stateful packet inspection hardware and software. We undertake stateful packet inspection practices for congestion management, traffic shaping, traffic pipelining, policy enforcement and other related network management purposes. In addition, for those data plans which do not include unlimited Multimedia Streaming, as part of our network management practices, we use stateful packet inspection to identify, meter, and deny, as appropriate, Multimedia Streaming services which are limited under the plan.
Our terms and conditions allow us to engage in network management, including to monitor, restrict, limit and/or meter services (including formats, such as Multimedia Streaming and file downloads) to preserve system capacity and provide acceptable service quality. Due to our limited spectrum resources and network capacity, our terms and conditions prohibit tethering and P2P file sharing. Such uses place an unreasonable burden on MetroPCS’ limited spectrum capacity. In order to enforce MetroPCS’ prohibition against tethering, MetroPCS’ CDMA and EVDO networks will deny traffic to destination ports that are typically identified used by as tethered devices, such as equipment running Windows operating systems on personal computers. Furthermore, P2P file sharing in many instances is used to distribute material that content owners have indicated to us is copyrighted material. Such P2P file sharing also presents special congestion issues for MetroPCS’ mobile broadband Internet access networks and services since the MetroPCS service is not designed for extended uplinking of data as is generally part of P2P file sharing services. Such P2P protocols and protocol combinations that are prohibited include Gnutella, eDonkey and Bit Torrent.
As part of MetroPCS’ network management practices and in an effort to reduce congestion caused by sessions which are not active, MetroPCS may employ some or all of the following techniques which are generally accepted Internet and mobile Internet practices: timing out idle data sessions including all idle TCP sessions after 15 minutes and all idle sessions after 2 minutes; and dropping packets which may exhibit malicious profiles or abnormal frequency of connections. Furthermore, MetroPCS limits the number of connections to its Domain Name System (“DNS”) server to 20, permits connections to its Multimedia Message Service Center (“MMSC”) servers on TCP ports 80/443/3128, permits connections to its voicemail to text system on TCP port 143, permits connections to its proxy server on TCP ports 80/3128, and denies access to all other MetroPCS internal networks. In addition, on MetroPCS’ CDMA and EVDO networks, MetroPCS will time out all HTTP/HTTPS TCP sessions after 5 minutes, all non-HTTP/HTTPS TCP sessions after 15 minutes, and all UDP sessions after 1 minute. Further, MetroPCS’ CDMA and EVDO networks will drop packets that have certain characteristics that MetroPCS has found may harm its network or represent malicious traffic including, but not limited to, traffic with the following IP options: route-record, router-alert, loose-source-route, strict-source-route, bad IP options, unknown protocols, stream, and security; and packets and connections with the following anomalies: SYN fragments, no TCP flags, SYN ad, FIN set, FIN no ACK, ICMP large packets, ICMP fragments, TCP port scans, TCP sweeps, UDP sweeps, ICMP sweeps, and abnormal number of simultaneous connections to the Internet (but only until excess connections dropped). In order to reduce the prospect of congestion caused by multiple connections, MetroPCS limits concurrent TCP connections to 32 and 16 embryonic connections, and concurrent non-TCP connections to 32. Due to these connection limitations, data sessions may not be available to some users at certain times.
While MetroPCS’ network management practices apply to subscribers on MetroPCS’ networks, other network management practices may apply when a customer is in an Extended Home Roaming area, or being served by a third party. MetroPCS has no control over the network management practices undertaken by such third parties which are different than or in addition to MetroPCS’ network management practices.
We may, in the future, change what types of traffic are allowed on our network, the network management practices used, and the setting for our network practices. As part of our network management practices, we continue to reserve the right to monitor, restrict, limit and/or meter types of traffic that we believe may impose undue costs, cause harm, be disruptive, or interfere with our systems or services to other customers and to deny certain types of traffic that may cause harm to the network.
Application Specific Behavior
As part of our network management practices, MetroPCS generally does not prioritize one type of data traffic over other data traffic. As described in the “Congestion Management” section, we may, however, monitor, restrict, limit and/or meter certain other types of traffic or content. We do currently limit uses of mobile devices according to the services we offer on our networks. For example, tethering a mobile device to provide data to another device currently is not an allowed usage on our network. Currently, we do not allow our mobile devices to be tethered to provide a data source for other devices on our network as part of our network management practices.
We provide coverage to our customers using our RAN networks, as well as through the RAN networks of other carriers. In certain areas of coverage, certain applications that may work on our RAN networks will not work on the RAN networks of others.
MetroPCS also does not allow P2P file sharing traffic over its networks. Certain service plans offered by MetroPCS also limit the amount of Multimedia Streaming which may be accessed using MetroPCS’ mobile broadband Internet access service. MetroPCS currently does not offer VoIP or video telephony services. VoIP services provided by third parties or applications are not limited or restricted by MetroPCS, but device type, network speed and congestion may limit the usability of VoIP on MetroPCS’ networks.
MetroPCS’ broadband mobile wireless network and services are designed and intended to be used solely with featurephones and smartphones because of our limited spectrum holdings and network capacity. As a result, we do not currently offer or provide mobile broadband Internet access service to connected devices on our networks, including, but not limited to, data cards, pucks or dongles, or tablet devices. Further, MetroPCS currently does not allow the mobile devices of our subscribers to be tethered to other devices, or allow the customers of other carriers to tether their mobile devices on our networks. Allowing tethering on the MetroPCS network would potentially exceed MetroPCS’ capacity for data services, and potentially denigrate the usage of MetroPCS’ mobile broadband Internet access service for many of its customers.
MetroPCS only operates networks using 1xRTT CDMA, EVDO, and LTE technologies using PCS and AWS spectrum. Devices which do not use 1xRTT CDMA, EVDO or LTE (on PCS or AWS spectrum) will not operate on MetroPCS’ networks. Further, devices which do not support WiFi will not operate in WiFi hotspots offered by MetroPCS. Further, devices obtained from other carriers may be locked and not useable on MetroPCS’ networks.
We currently offer a program that allows consumers to attach their own featurephone or smartphone to the MetroPCS network. This program is called MetroFlash. The handsets available to be provisioned on the MetroPCS network using the MetroFlash program, as well as additional details about the MetroFlash program, may be found at http://www.metropcs.com/metroflash/. Currently, MetroPCS is unable to modify the parameters of devices provisioned on MetroPCS’ networks using the MetroFlash program to support data services. Additionally, MetroPCS itself tests and authorizes all mobile devices it offers to its customers, as well as all applications offered directly from MetroPCS to its customers in an effort to ensure that its customers have a complete end-to-end experience that will enable them to enjoy the data services provided by MetroPCS. The processes for such testing and authorization is conducted by MetroPCS’ Engineering team. In order to provide a complete end-to-end experience for our customers, only MetroPCS tested and approved mobile devices or mobile devices activated using the MetroFlash service will work on MetroPCS’ networks.
Upon the execution of a non-disclosure agreement, potential vendors may receive access to documents, related to the MetroPCS approval process, device requirements, application requirements, and test plans by sending an email to firstname.lastname@example.org. Applicants will receive an email confirming receipt of their email and attaching an application form (“Application”), which may be in the format of an online form or a Microsoft Word document. Applications may be reviewed by a 3rd Party to ensure that all Applications are complete. Applicants will be contacted regarding next steps if, and only if opportunities exist at MetroPCS within their core competency areas.
We take care to ensure that the devices and applications MetroPCS makes available for the use of data services will function properly on our mobile broadband Internet access networks, and on the mobile broadband Internet access networks of other carriers where our customers are authorized to roam. Accordingly, not all mobile devices are allowed on our mobile broadband Internet access networks or will work with the mobile broadband Internet access networks of other carriers whose coverage we offer to our customers, nor are all applications made available from MetroPCS directly to our customers. Similarly, not all available applications will be offered directly from MetroPCS to our customers.
